Terms of service for the thinkapenny.ai chat application.

Agreeing to these terms

Using thinkapenny.ai chat means you accept these terms. If you are using it for an organisation, you are confirming you may accept them on that organisation's behalf. If you do not accept them, do not use the service.

What this service is

The chat is a conversational interface to language models. Some run on our own hardware; others are third-party models reached on your behalf, or with a provider key you have brought yourself.

Conversations are kept where you choose and nowhere else — in your browser, in your own Google Drive, or not at all. That choice is yours to change at any time, and what each option means is set out in the privacy policy.

Your content, and what models produce

Your account is yours alone

Acceptable use

You may not use thinkapenny.ai chat, or anything it produces:

No reselling

Access is sold to you, for your own use. You may not resell, sublicense, rent, lease, or otherwise make thinkapenny.ai chat available to a third party as a service, whether for money or not. You may not act as a broker, proxy, or intermediary that lets other people make requests through your account or your API key.

Building your own product that uses the API under your own account is fine and expected. Reselling the API itself, or passing raw access through to people who have no account here, is not.

Text messages

thinkapenny.ai chat sends SMS text messages only to a mobile number you have given us and only for the purpose you gave it for — chiefly one-time passcodes and account or security notices relating to your own account. We do not send marketing or promotional text messages.

Supported carriers may change without notice.

Availability and change

The service is provided as it is. We do not promise it will be available, correct, or uninterrupted, and models make mistakes — output should be checked before it is relied upon for anything that matters. We may change, suspend, or discontinue features, and will give notice where we reasonably can.

Liability

To the extent the law allows, thinkapenny.ai is not liable for indirect, incidental, or consequential loss, or for lost profits or data, arising from your use of the service. Nothing here limits liability that cannot lawfully be limited.

Paying for what you use

Some plans include a fixed allowance for a fixed price. Others charge for what you actually use, per unit of text processed, at the rates published at /chat/rates. Which kind of plan you are on, and what it allows or charges, is shown when you choose it and on your allowance page.

We will give notice of a rate change in the application before it takes effect, where it is practical to do so. If you do not accept a new rate, stop using the usage-based plan — continuing to use it after a change takes effect is acceptance of it.

Ending it

You may stop using the service and ask us to close your account at any time. We may suspend or close an account that breaks these terms, that puts the service or other users at risk, or that we are required to act on — and we will say why unless we are prevented from doing so.

When an account is closed we delete what identifies you and keep a record of the account itself — when it opened and closed, which terms you accepted and when, what the account was charged, and what credit was paid in and forfeited. We keep that record for as long as we may need it to answer a legal or financial question about the account. Closing an account does not entitle you to a refund of credit; see Paying for what you use above. If you open a new account later it is a new account, with no credit, history or settings carried over from the old one.

Changes and contact

If these terms change, the date at the top changes with them, and material changes are announced in the application. Questions and notices go to admin@thinkapenny.org.
